Mason injures back in fall from makeshift staging
Defendants: unaware of jerry-rigged set-up; $325,000 settlement
On his first day on the job as a mason the plaintiff was working at a site in Connecticut. The employer had erected staging, but because it did not allow the plaintiff to reach the necessary height to complete the work. he and or his co-workers jerry-rigged five or six pallets and planks on an outrigger to reach the necessary level.
As he walked up the improvised lift, the plaintiff lost his balance and fell to the level below, badly injuring himself The accident occurred within 15 minutes of the opening of the site.
Suit was filed against the general contractor and construction manager. The defendants denied knowledge of the set-up.
One week before the scheduled trial, and before the court could rule on which state law applied (Connecticut law was deemed by the parties to be more conservative than Massachusetts law, according to plaintiffs counsel), the case settled at mediation.
