Temporary fence blows down, lands on worker
The plaintiff, a 64-year-old demolition supervisor, was working at a construction site when a temporary fence blew over and collapsed on top of him.
The fence had been set up at one location and later moved by the general contractor to a patch of uneven terrain, where it fell.
The plaintiff sought medical treatment shortly after the accident and continued working for two months before being laid off. He underwent three arthroscopic surgeries, followed by a total knee replacement.
The plaintiff sued both the general contractor and the fence manufacturer and received workers' compensation benefits while the suit was pending. The case settled after two days of mediation, with the workers' compensation insurer waiving its lien.
